Second Water Permit Challenge to be Heard Aug. 31 in Manhattan
Oral arguments in the second suit filed by Sierra Club and Hudson River Fisherman’s
Association challenging DEC's procedures in issuing water withdrawal
permits under New York's new permitting law will be heard Wed.,
August 31, 2016 in New York County Supreme Court in Manhattan.
The case, Sierra Club and HRFA v. Martens II, Index No. 100524/2015,
challenges DEC's issuance of a water withdrawal permit to Consolidated
Edison for its East River generating station to take up to 373
million gallons of water per day from the East River in the Hudson
River estuary.
The hearing will be before Justice Alice Schlesinger at 2:30 pm in Part 16, 60
Centre Street, Room 222, Manhattan. Attorney Richard Lippes from
Buffalo will do the oral argument for the petitioners. Members
of the public are welcome to attend.
